Your agreement with us

In these terms and conditions (Terms of Use):

  1. a reference to “we”, “us” and “our” is a reference to the Grimsey Group (defined below); and
  2. a reference to “you” or “your” is a reference to any person accessing, reviewing or using the Grimsey Group website currently located at www.grimsey.com.au (the Website).
  3. By using the Website, you agree to be bound by these Terms of Use.

Who is the Grimsey Group?

The Grimsey Group is comprised of the entities detailed in the Annexure below, being:

  • Grimsey Pty Ltd;
  • Grimsey Wealth Pty Ltd;
  • Grimsey Accounting NSW Pty Ltd; and
  • Grimsey Wealth NSW Pty Ltd.

Each Grimsey Group entity has ownership in common with the others to varying degrees, and do have common officers and employees.

If a client is referred from one entity to another, no Grimsey Group entity pays a referral fee or commission to another of the Grimsey Group entities. Each Grimsey Group entity charges the client separately for the services which it supplies to the client.

When you engage a Grimsey Group entity to perform services, there will be terms and conditions specific to those services (Specific Terms). Those Specific Terms operate in conjunction with these Terms of Use, but to the extent there is any inconsistency between the Specific Terms and these Terms of Use, the Specific Terms prevail.

Any financial services (such as financial product advice or other financial services) provided by the Grimsey Group are provided by:

  • Grimsey Wealth as the holder of Australian financial services licence No. 293334; or
  • Grimsey Wealth NSW as authorised representative 444081 of Grimsey Wealth.

Any credit related services provided by the Grimsey Group to which the National Consumer Credit Protection Act 2009 (Cth) applies are provided by Grimsey Wealth.  Grimsey Wealth holds Australian credit licence 293334.

General Advice Warning

The Website is designed and intended to provide general information only, in summary form, regarding the Grimsey Group, its services, and financial, tax, wealth management and accounting topics, current at the time of publication, for general informational purposes only. 

To the extent that the Website contains any financial advice or information, this is general advice only or information that is general in nature.  It does not take into account your investment objectives, financial situation or particular needs. To the extent permitted by law, we exclude liability for all direct, indirect or consequential liabilities, losses, damages, costs and expenses (including, without limitation, loss of revenue, loss of goodwill, downtime costs, loss of profit, loss of or damage to reputation, loss under or in relation to any other contract, loss of data, loss of use of data or loss of anticipated savings or benefits), whether arising in contract, tort (including negligence) or otherwise, suffered or incurred by any person in connection with or in any way relating to the Website or any content or services provided or made available through the Website.

The Grimsey Group:

  • does not represent, warrant or guarantee that:
    • information available on or via the Website is always accurate, current, suitable or complete;
    • access to the Website will always be available, uninterrupted or error-free, or that the Website will be able to be accessed through all web browsers;
    • this Website is free from computer viruses, programming bugs, interferences or any other defect or error which may affect your software or systems;
    • the Website will not cause damage;
  • uses its best endeavour to maintain the accuracy of information available from the Website, however, some or all of the information may, from time to time, be amended, or become superseded or otherwise inaccurate;
  • makes changes periodically to the information on the Website; and
  • is not responsible for delays, errors, inaccuracies, or omissions due to a failure in a computer system, ancillary equipment, software, or any other circumstances beyond its direct control.

The transmission of data over the internet is not always secure. Although we endeavour to secure this Website, we are not liable for any breaches of security computer ‘hacking’ and you use this Website entirely at your own risk.

Your ability to access our Website will depend on factors out of our control.  You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular protection and requirements for the accuracy and integrity of data input and output.

You indemnify and agree to keep us indemnified against any loss or damage or costs incurred by us in connection with your breach of these terms or of any other legal obligation by you or your use of or conduct on the Website.

Professional Standard Scheme

For each of Grimsey and Grimsey NSW: Liability limited by a scheme approved under Professional Standards Legislation.

Each of Grimsey and Grimsey NSW are members of a Professional Standards Scheme.  As a result, where any of Grimsey and Grimsey NSW provide you with accounting, tax, SMSF-related or bookkeeping services their liability will be limited under the relevant Professional Standards Scheme.

No client-adviser relationship created

Your use of the Website and the receipt of any information from us does not create, nor is it intended to create, a client-adviser relationship between you and the Grimsey Group.

Our use of the terms ‘Director’ and ‘Adviser’

On this Website and more generally:

  • we may use the term ‘Director’ to signify our most senior staff in the firm.  It does not, and is not intended, to signify that each ‘Director’ so identified is also an officer (within the meaning set out in section 9 of the Corporations Act 2001 (Cth)) of any of the Grimsey Group entities, although some of our Directors may also be ab officer of one or more of the Grimsey Group entities.
  • Grimsey Group’s staff may hold a title of ‘adviser’, ‘senior adviser’ or similar terms. The use of the terms ‘adviser’, or ‘senior adviser’ is used to denote their position, role and seniority, and it does not, and is not intended to, signify that such ‘adviser’ or ‘senior adviser’ is necessarily also a ‘financial adviser’ or ‘financial planner’ within the meaning of section 923C of the Corporations Act 2001 (Cth), although some of our advisers or senior advisors may also be a financial adviser or financial planner.

Client Portal

Some Grimsey Group clients will utilise client portal (Client Portal) services available through the Website to access information about their particular matters.  Information that is available through the Client Portal is provided for convenience only and Grimsey Group does not warrant its accuracy or that it is up to date and complete.

We may choose to issue you with a username and password to enable you to access the Client Portal through our Website. If we do, you must keep those details confidential. We will not be responsible for any misuse of your Client Portal due to your deliberate or accidental dissemination of your username or password details.

Intellectual Property

The Website contains intellectual property, including trademarks and copyright, together with any goodwill or reputation and intellectual property rights subsisting in those things. You should assume that intellectual property on or in this Website is owned by the Grimsey Group or third parties, and unless permitted by law, you must not copy, reproduce, transmit, display or otherwise distribute any of that intellectual property in whole or in part without our prior written consent.

General Terms

These Terms of Use are governed by the laws in force of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the Courts of Victoria, Australia in respect to any claim made by any party against another which in any way arises out of or in connection with the Terms of Use.

The Terms of Use are in addition to, and not in derogation of, any other policy documents or notices that appear elsewhere on the Website, including the Privacy Policy, and the terms and conditions that you may have with the respective Grimsey Group entities when you engage them to perform services. The Terms of Use must be interpreted accordingly.

The Terms of Use may be varied from time to time and without notice to you. Please ensure that you review these Terms of Use regularly as you will be deemed to have accepted a variation if you continue to use the Website after a variation to them has been posted to the Website.

If any part of the Terms of Use is determined to be illegal, invalid or otherwise unenforceable or void, that part shall be severed to the extent necessary and the remainder terms shall continue in full force and effect.

No waiver of any breach of these Terms of Use will be construed as a waiver of any other breach of these Terms of Use.
